Does The Emancipation Date Change If A Child Is Held Back In School?

child studyingQuestion:

My daughter has been held back in school multiple times and her mother does not force her to apply herself. I’m supposed to pay child support until she graduates, but will the emancipation date change because of these setbacks?

Answer:

While I am not licensed to practice law in Pennsylvania and am unable to give you legal advice, I can give you some general observations on this issue based on the jurisdiction where I practice.

Where I do practice in Virginia, child support is controlled by statute. Child support will last until the child turns 19 or graduates from high school, whichever first occurs. So, while the court will not consider why the child has been held back a grade, it will end child support upon the child turning 19.

Child support is very jurisdiction-specific and requires a specialized knowledge of local law. For these reasons I would suggest you contact an attorney who specializes in family law matters in your jurisdiction.

Remember, I am unable to provide you with anything more than tips on these matters, so please contact an attorney in your jurisdiction to obtain specific advice as to the laws of Pennsylvania and how they impact your case.
