How Long Do I Have To Respond To Divorce Papers?

divorce papersQuestion:

I was recently served divorce papers and told I have 21 days to respond to the court. Is that 21 days after my spouse files or 21 days after I was served the papers?

Answer:

While I am not licensed to practice law in your state and am unable to give you legal advice, I can give you some general observations on this issue based on the jurisdiction where I practice.

Where I do practice in Virginia, when you are served documents you have 21 days to respond from the date of service not the date of filing. In Virginia weekends and holidays count towards your 21 day limit. It should be noted that other jurisdiction calculate the 21 days differently.

Procedural rules are very jurisdiction-specific and require a specialized knowledge of local law. For these reasons I would suggest you contact an attorney who specializes in family law matters in your jurisdiction.

Remember, I am unable to provide you with anything more than tips on these matters, so please contact an attorney in your jurisdiction to obtain specific advice as to the laws of your state and how they impact your case.
