What are the differences between getting a divorce with children or without children?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Texas divorce laws where I am licensed to practice.

There are no procedural differences whether you are getting a divorce with children or without children. In Texas, there is still a 60-day waiting period from the time the Original Petition is filed until your divorce can be finalized.

A divorce without children often times does not take as long to settle or as lengthy of a trial, because there are fewer issues to be resolved.

In a divorce with children, a Parenting Plan and child support orders have to be entered, which often is a lengthy process.

However, this is not to say that a divorce without children is always a speedy, uncomplicated process. The length of the process often depends on the relationship of the parties (amicable or contentious), how much property is involved and the nature of it, and whether children are involved.
