I want to divorce my wife because we have been separated for a couple years and now she is pregnant with her boyfriend’s child.
Can I get a divorce while my wife is pregnant with another man’s baby?
Answer:

A party can file for a divorce on ground of incompatibility (the terminology varies by state) if a party no longer wishes to be married and meets the residency requirements of that state. Where I practice, a party must live in my state for six month and the county in which they file for 30 days prior to filing.
In regards to the unborn child, there is a legal presumption that the child is one of the marriage since the parties were married at the time the child was conceived. It will have to be proven that the child is not a child of the marriage.
