Collecting Child Support On Two Separate Court Orders

My divorce case was dismissed, but I have had to continue paying child support awarded through the temporary order.

She also recently asked for and was awarded a plenary order of protection that includes another award of child support on this order.

Can she collect child support on both orders?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Missouri divorce laws where I am licensed to practice.

Generally, if a divorce case has been dismissed then any temporary order of child support would also be dismissed along with it.

Where I practice, judges would not allow a “double dip” on child support and would blend the two orders into one.

My suggestion would be to contact the child support enforcement agency in your state to see what orders are currently pending against you and how much you owe.
