Question:
I am in the military and pay child support. Should my Basic Allowance for Housing (BAH) be counted as income for calculating child support?
I would be receiving BAH regardless of whether I had dependents or was married.
Answer:
I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Indiana child support laws where I am licensed to practice.
Typically, income received for allowances is considered in your income for purposes of determining child support. The language of your divorce decree and any subsequent child support or custody orders would determine what was included in your current obligation.
If you receive an additional allowance due to having joint custody or primary custody of your children, then the amount of the full allowance would be included.
If you do not have joint or primary custody and therefore only receive the allowance at the rate without dependents, then that is likely the rate which would be used in future child support obligation calculations.

Can My Post 9/11 GI Bill be calculated as income for child support
I currently receive a stipend for my housing and books. I am going through a modification of custody, but my ex is asking the court to count my GI Bill money as income to be included when calculating child support. I will be graduating in a month and will no longer receive this money. Can the judge still include this as “disposable income”?
