Question: My wife and I are considering legal separation but we are unclear as to the time limit in the state of Tennessee. Is it only for a year or can it be longer?
Because of a heart condition, she is considered uninsurable and needs to stay on my insurance. Is legal separation our only option?
Answer:
I do not practice in Tennessee. Because your question is regarding a specific state’s statutes, you need to contact an attorney licensed in Tennessee. Cordell & Cordell has attorneys licensed and located in Tennessee who would be happy to explore your options with you.
I do have to caution you that many insurance companies are treating legal separation like a divorce. Many insurance companies are dropping the spouse after learning of the legal separation. You should contact your insurance company to ensure that they will continue coverage despite a legal separation.
