Ask A Lawyer: Can I Get Visitation with a 2-Month Old?

Question:

My wife walked out on me last week. We have a two month old girl and I want to get her every weekend but my wife tells me that she is too small of a child for this. However, I was the parent that got up with her at night and have proven that I am capable of taking care of her. Is she wrong, can I get her overnight at this age?

Answer:

This question requires knowledge of whether your local courts have parenting time (or visitation) guidelines. If there are (sometimes they are statewide, or sometimes they are local to the county), you can refer to them for assistance.  If there are no formal guidelines, then consult with an attorney who practices family law in your county to see what courts and practitioners there use for guidance.
