Can I Stop Maintenance After She’s Remarried?

Question:

How do I end maintenance now that my ex spouse is remarried?

My decree states that I had to pay for three years but says nothing about if she got remarried.

 

 

 

Answer:

Maintenance varies in every state.

It is not necessarily true that remarriage will trigger the termination of the maintenance.  If your Decree says three years with no provision for early termination upon remarriage, then you may be stuck paying for 3 years.

I would contact your divorce attorney to review your decree.
