Question:
Our divorced child just passed away without a will dividing his assets among his two minor children.
Does his ex-wife have a right to his inheritance if there is no will in place? Should we as grandparents get involved to protect our grandkids?
Answer:
I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Oklahoma divorce laws where I am licensed to practice.
Where I practice, ex-spouses have no right to inheritance. Since there are two children, the estate would be divided equally among the children.

Based on the limited amount of information I have regarding your question, the only reason why I see for the paternal grandparents to get involved is to ensure that the portion of the estate given to the minor child is properly kept in trust until that child reaches the age of majority.
Remember, I am unable to provide you with anything more than divorce tips for men, so please consult with a divorce lawyer in your jurisdiction.
