How do child support laws apply to wage garnishment?

mens divorce lawyer Janet Yu JohnstonQuestion:

I need financial advice on divorce. How do child support laws apply to wage garnishment?

My oldest son is now emancipated so how do I get the child support agency from stop garnishing my paychecks?

Answer:

I am not licensed to practice law in your state so I cannot offer legal advice on divorce. However, I can give you a general answer that may be helpful to you.

In general, in order to ensure that the wage assignment ends, you may need an order from the court to give to your employer to ensure they cease the payroll garnishment immediately.

In order for the support obligation to end, the child support enforcement agency in your state likely requires a Termination of Child Support Order since support does not automatically terminate in most states, according to child support laws.

To stop the collection, you have to file a motion with the court that originally ordered the support.

Again, as I am unfamiliar as to the specific laws for your state, I recommend speaking to a lawyer licensed in your state in regards to your current situation.
