Is Moving Out Of The Marital Home Ever A Good Idea?

Question:

My soon-to-be-ex-wife wants me to temporarily move out of the marital home during our divorce until she finds an apartment that she would then move into and I would be allowed to move back home.

Is this a problem for me if I get her to sign something stating that this is only temporary until she is ready to move? I don’t a possible move to come off as abandonment.

Generally, Cordell & Cordell divorce lawyers advise our clients against moving out of the marital home until the divorce is finalized or there is a court order awarding one spouse possession of the residence.

If you voluntarily leave the residence, you risk that your wife will not let you return to the residence. The move will give the appearance to the court that you do not want or need the house.

Additionally, if you have children, you risk the court perceiving you leaving the residence as conceding custody of the children to your wife. We recommend that you do not move out of the residence until the divorce is finalized.
