Question:
Per our child custody agreement, my summer visitation consists of three separate one-week periods during June, July and August with my daughter.
However, trying to schedule this parenting time is a constant battle since my ex-wife insists the schedule has be to convenient for her.
Can I file an amended parenting plan template with the court that ensures my summer visitation times are a set date for each month?
Answer:
Many child custody orders provide for custody arrangements during the summer months that are similar to yours. Many of them even provide a process for how the weeks are to be determined and set a time frame for doing so.
A Family Access Motion may be filed if custody or visitation is denied or interfered with by a parent without good cause. Under the facts that you have set out, if you were to decide to file a Family Access Motion, you would need to be able to show to the court that your daughter’s mother has denied and interfered with your summer custody or visitation.
Your daughter’s mother would be entitled to offer evidence to either deny this or to explain why she has done so. If she were able to convince the judge that there was good cause for her doing so, the judge would likely deny your Family Access Motion.
You would need to specify in your Family Access Motion the specific facts that support your claim. You would also specify what it is that you are asking the court to do. That could include setting forth your specific request for setting the summer visitation times.

Are there any stipulations regarding age during summer visitation with the non costodial parent? We were never married. My child is only 11 months old and has only had visitation every other weekend with the father for the past 4 months. I am very uncomfortable with him getting my child for 2 weeks each month of the summer. I am still breastfeeding. What can I do?
